Could be that Gibbons hoped to derail former Gube Kenny Guinn's last minute appointments to the Nevada Gaming Control Board, although the crack Gibbons' team denies it. One legalistical theory says that if Gibbons became Gube before the positions became officially vacant at midnight on the 1st of January, then only Gibbons and not Guinn would have the authorita to make the appointments.

But of course it only gets weirder as it turns out that Gibbons was sworn in 12 seconds after midnight, so there is a legalistical a argument saying that Gibbons was too late: Guinn was gube at midnight, so he had authorita. Looks like the new Attorney General will have to sort it all out.
